Legislative Consent: Subsidy Control Bill

The Subsidy Control Bill (the Bill) was introduced in the House of Commons on 30 June 2021.

 

The long title to the Bill notes that it is a Bill “to make provision regulating the giving of subsidies out of public resources; and for connected purposes.”

 

The Bill is subject to the legislative consent process under Standing Order 29. This is when the consent of the Welsh Parliament is sought by the UK Government to legislate on an issue which falls within the competence of the Senedd.

 

The Legislative Consent Motion for the Subsidy Control Bill was not agreed in Plenary on 1 March 2022.

 

Supplementary Legislative Consent Memorandum (Memorandum No. 2) – January 2022

 

On 6 January 2022, the Welsh Government laid a Supplementary Legislative Consent Memorandum. (PDF 81.5KB).

 

The Business Committee agreed (PDF 38.8KB) that the Supplementary Legislative Consent Memorandum on the Subsidy Control Bill (Memorandum No. 2) will be considered and reported on, to the Senedd, by 3 March 2022.

 

On 8 February 2022, Business Committee agreed to amend the reporting deadline to 1 March 2022.

 

The Legislation, Justice and Constitution Committee laid its report (PDF 157KB) on 24 February 2022. 

 

Legislative Consent Memorandum – July 2021

 

The Welsh Government laid a Legislative Consent Memorandum (LCM) (PDF 112KB) on the Bill before the Senedd on 13 July 2021.

 

The Business Committee agreed (PDF 38.5KB), in accordance with Standing Order 29.4(i), to invite the Economy, Trade and Rural Affairs Committee and the Legislation, Justice and Constitution Committee to consider and report on the Legislative Consent Memorandum on the Subsidy Control Bill, to the Senedd, by 4 November 2021.

 

On 4 November 2021, the Business Committee agreed (PDF 39.3KB) a new reporting deadline of 16 December 2021.

 

The Legislation, Justice and Constitution Committee laid its report (PDF 255KB) on 7 December 2021. The Welsh Government responded (PDF 332KB) on 6 January 2022.

 

The Economy, Trade and Rural Affairs Committee took evidence on the LCM at its meeting on 21 October 2021 and laid its report (PDF 195KB) on the LCM on 9 November 2021. The Chair also wrote to the UK Minister for Business, Energy and Industrial Strategy on 9 November 2021 to draw attention to issues raised in the report.
