Legislative Consent: The Leasehold Reform (Ground Rent) Bill

The Leasehold Reform (Ground Rent) Bill (the Bill) was introduced in the House of Lords on 12 May 2021.

 

The long title to the Bill notes that it is a Bill “to make provision about the rent payable under long leases of dwellings; and for connected purposes.”

 

The Bill is subject to the legislative consent process under Standing Order 29. This is when the consent of the Welsh Parliament is sought by the UK Government to legislate on an issue which falls within the competence of the Senedd.

 

The Legislative Consent Motion for the Leasehold Reform (Ground Rent) Bill was agreed in Plenary on 14 December 2021.

 

Supplementary Legislative Consent Memorandum (Memorandum No. 3) – December 2021

 

On 3 December 2021, the Welsh Government laid a Supplementary Legislative Consent Memorandum (PDF 142KB).

 

The Business Committee agreed (PDF 44.3KB) that the Supplementary Legislative Consent Memorandum on the Leasehold Reform (Ground Rent) Bill (Memorandum No. 3) will be considered and reported on, to the Senedd, by 14 December 2021.

Supplementary Legislative Consent Memorandum (Memorandum No. 2) – November 2021

 

On 26 November 2021, the Welsh Government laid a Supplementary Legislative Consent Memorandum (PDF 169KB).

 

The Business Committee agreed (PDF 38.9KB) that the Supplementary Legislative Consent Memorandum on the Leasehold Reform (Ground Rent) Bill (Memorandum No. 2) will be considered and reported on, to the Senedd, by 9 December 2021.

 

The Legislation, Justice and Constitution Committee laid its report (PDF 189KB) on Memorandum No. 2 on 9 December 2021. The Welsh Government responded to the report on 13 December 2021.

 

Legislative Consent Memorandum – May 2021

 

The Welsh Government laid a Legislative Consent Memorandum (LCM) (PDF 145KB) on the Bill before the Senedd on 26 May 2021.

 

The Business Committee referred the LCM to the Local Government and Housing Committee and the Legislation, Justice and Constitution Committee, with a reporting deadline of 14 October 2021. (PDF 41.1KB)

 

At the meeting of 28 September 2021, Business Committee agreed (PDF 39.4KB) to extend the reporting deadline to 18 November 2021.

 

At the meeting of 4 November 2021, Business Committee agreed (PDF 39.8KB) to extend the reporting deadline to 2 December 2021.

 

At the meeting of 23 November 2021, Business Committee agreed (PDF 40.3KB) to extend the reporting deadline to 9 December 2021.

 

The Legislation, Justice and Constitution Committee was due to take evidence from the Minister for Climate Change at its meeting on 15 November 2021. However, due to unforeseen circumstances, the session was cancelled at short notice. In lieu of the evidence session, the Committee wrote to the Minister on 15 November 2021, and the Minister responded on 16 November 2021.

 

The Legislation, Justice and Constitution Committee laid its report (PDF 275KB) on 7 December 2021. The Welsh Government responded to the report on 13 December 2021.
