Paper 1 – Legal briefing on the implications the Wales Act 2017 has the Section
36 of the Government of Wales Act 2006

The Committee’s Legal Adviser gave an oral briefing to supplement his paper on
S36 of the Government of Wales Act 2006.
3.2
The Commissioner for Standards gave his views on the relevant section and suggested
that he speaks with the Director of Public Prosecution to ascertain if he feels
the present arrangements are satisfactory. He also suggested that he revisits
the Protocol between the National Assembly for Wales, the Commissioner for Standards,
the Chief Constable of South Wales Police and the Crown Prosecution Service on
the Investigation of Alleged Offences under Section 36(7) of GOWA.
3.2
The Committee asked the Commissioner for Standards to proceed as suggested and agreed
to reconsider this issue once he has his findings.
