Members considered the evidence sessions held on 3 October and 7 November in relation to this petition and P-04-575 Call in all Opencast Mining Planning Applications, and agreed to produce a report on the Committee’s consideration of both petitions.

The Committee heard evidence from Lesley Griffiths AM, Neil Hemington and Joanne Smith.

 

The Cabinet Secretary agreed to investigate further, comments attributed to the planning inspector during an appeal hearing over an application for an opencast mine at Varteg Hill, and write to the Committee.

The Committee reviewed the evidence session held on 18 February and agreed to:

1.   Invite Planning Inspectorate Wales in to give evidence on the issues raised in the petition and the consistency of approach amongst those involved in the process;

2.   Write to the Minister seeking his views on the petitioner’s further comments; and

3.   Write to the WLGA, seeking their views on how the process is managed across all local authorities.

The Committee considered correspondence on the petition and agreed to;

 

·         await the Minister’s attendance in February;

·         write to the Minister to seek clarification of the sort of questions he will be unable to address until the Varteg Hill application has been decided; and

·         consider inviting stakeholders to give evidence in the New Year.

 

The Committee also noted with sadness the death of the lead petitioner’s wife and agreed that the Chair should write to Dr Cox to express Members’ condolences.

Members discussed the evidence session on 14 May and discussed the areas they wish to pursue with the Minister when he gives oral evidence. Members also agreed to;

 

·         write to the WLGA seeking their views on the status of MTAN;

·         write to the Minister for Housing and Regeneration asking for clear definitions of the ‘exceptional circumstances’ when the 500 meter buffer can be waived; and

·         invite the Planning Inspectorate to give oral evidence.
